Online Banking Agreement

Jonah Bank of Wyoming - Online Banking Agreement and Disclosure Statement

This agreement together with the Deposit Account Agreement, Your Account Rules and Regulations, and any written application for Online Banking, as they may be adopted and/or amended from time to time, serve as our agreement with you governing your use of Online Banking and your deposit accounts accessed through Online Banking. By accessing Online Banking you accept and agree to be bound by the terms and conditions of the agreement, to be responsible for all authorized transactions initiated through Online Banking, and will be responsible for any unauthorized transactions to the extent permitted by law.

“You” and “your” mean each person who establishes an Internet banking customer account with us or who uses, or is authorized to use, an Online banking logon ID and password. The term “Online Banking” means our service that allows you to access accounts, make payments, obtain information, transfer funds, and perform other transactions over the Internet by use of a personal computer.

You understand you will be responsible to safeguard your logon ID and passwords. Anyone to whom you give your logon ID and password will have full access to you accounts. The Bank CANNOT monitor any signature restrictions on your accounts (i.e. two signatures required, etc.) and must rely on the accuracy of the logon ID and passwords established. Savings and Money Market accounts are limited by regulation to six pre-authorized transfers or withdrawals per monthly cycle, no more than three of which may be made by check, draft, debit card or similar order of payment to third parties.

When you enroll on the Jonah Bank of Wyoming website for Online Banking, you will select your logon ID. All Online Banking transactions or inquiries must be initiated by use of your Logon ID and your password. The Bank will assign you a temporary password at the time of enrollment. The first time you sign on to Online Banking you will be prompted to select a new password. Going forward, the system will prompt you to change your password every 2 months.

You must have enough funds available in the account from which you would like to initiate a transaction against, otherwise the transaction could overdraw your account. If the overdraft is not covered by an approved line of credit relating to the overdrawn account, you agree to make immediate payment to us of the amount of the overdraft, and all applicable fees that are assessed.

You are liable for all transactions that are made or authorized, even if the person you authorize exceeds the authority that you gave them. If you believe your Online Banking identification number or password have been lost or stolen or that someone has used them without your authorization, call us immediately during normal business hours and also immediately provide written notice to us.

You are responsible for the purchase, hook-up, installation, loading, operation, and maintenance of all hardware and software, and the internet access to your personal computer, and all related costs.

IN NO EVENT SHALL THE BANK BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMEAGES, INCLUDING LOST PROFITS (EVEN IF WE ARE ADVISED OF THE POSSIBILITY THEREOF, COSTS, EXPENSES, OR LEGAL FEES,) ARISING IN ANY WAY OUT OF THE INSTALLATION, USE, OR MAINTENANCE OF ANY COMPUTER EQUIPMENT, THE ONLINE BANKING SERVICE AND/OR BILL PAYMENT SERVICE.


The Bank will not be liable:

  • If you do not have enough available funds in the account from which a payment or transfer is to be made, or if the account has been closed or is not in good standing, or if we reverse a payment or transfer due to cause.
  • If any payment or transfer would go over the credit limit of any account.
  • If your equipment or ours was not working properly and the breakdown should have been apparent to you when you attempted to conduct the transactions.
  • If you do not properly follow our instructions or if you provide us with wrong or inaccurate information or fail to correct or tell us about any inaccuracy of which you are aware.
  • If the money in the account from which a payment or transfer is to be made is subject to legal process or other claim restricts the transaction.

Your Online Banking payments and transfers will be indicated on the monthly statements we provide or make available to you. You agree to notify us promptly if you change your address or if you believe there are any errors or unauthorized transactions on any statement, or statement information.

Before paying a bill online, please set up the payee on the Bill Pay system and allow yourself time before the first payment date. The payment date you designate must be a business day. Please allow 3-5 business days for automatic payments and 5-7 business days for bill payment by check to insure payment by due date.

Electronic payments made through Bill Pay are limited to a maximum of $99,999.99 each and cannot be paid to government agency payees or to payees outside the United States. Email payments and transfers made through Bill Pay are limited to $2,500.00 and cannot be paid to government agency payees or to payees outside of the United States. The cut-off hour for bill payment transactions is 2:00 p.m. All transactions performed after 2:00 p.m. will be processed on the next business day.

We may disclose information to third parties about your account(s) or transfers if it is necessary for investigating and resolving errors, to combat fraud, and to comply with government agency or court orders.

For purpose of this disclosure, our business days are Monday through Friday. Holidays and weekends are not included. Our cut-off hour for making transfers though Online Banking is 5:00 p.m. All transactions performed after 5:00 p.m. will be processed on the next business day.

Regulation E disclosure.
